Permit & Carry Requirements

New Mexico is a shall-issue state requiring a Concealed Handgun License (CHL) for concealed carry, issued by the Department of Public Safety. Applicants must be at least 21, complete 15 hours of firearms training including live fire, pass a background check, and meet all eligibility requirements. Open carry is generally permitted without a license in New Mexico.

Reciprocity

New Mexico honors concealed carry licenses from states that have reciprocity agreements with New Mexico. The New Mexico CHL is recognized by a number of states. Non-residents visiting New Mexico should verify whether their state's permit is honored before carrying. New Mexico has a red flag law.

Prohibited Locations

New Mexico prohibits carry in schools and on school grounds, prisons and detention facilities, courthouses, hospitals, polling places on election day, and establishments licensed to serve alcohol on the premises. Private property owners may also prohibit firearms. Some municipalities in New Mexico have enacted additional restrictions.

NFA Items in New Mexico

New Mexico permits federally-registered NFA items including suppressors, SBRs, and SBSs. New Mexico has no state-level restrictions on NFA items beyond federal requirements and no magazine limits or assault weapon ban. The $200 NFA tax stamp elimination effective January 1, 2026 applies to New Mexico residents.
